Camera regulations for our German parks

1. WHAT IS THE SCOPE OF THIS NOTICE?   

As we are committed to the safety of our visitors and staff, we use a closed-circuit television system (“CCTV”) in our parks. This CCTV Privacy Notice (the “Notice”) supplements the CCTV sign displayed in RCN’s premises, to inform you about how the CCTV system will be managed and used by RCN, whose personal data is captured, how and why that personal data is processed. RCN will ensure that its use of the CCTV system and the related personal data processing activities comply with the applicable (local) data protection laws, including the General Data Protection Regulation (GDPR).

2. WHO COLLECTS THE PERSONAL DATA?  

Recreatiecentra Nederland B.V. together with the park you are visiting (an overview of the RCN entities can be accessed via: https://www.rcn.nl/de/impressum. (“RCN”, “we”, “us”, or “our”) are the data controllers of the personal data collected about you (“You”) in the context of the CCTV. This means that we are responsible for processing your personal data and for responding to any requests you may have in accordance with applicable data protection laws. It is therefore important that you read this Notice carefully to understand how and why we use your personal data, and how we protect it.

3. WHOSE PERSONAL DATA DO WE PROCESS?   

This Notice applies to visitors and staff present in our parks and in all other RCN premises whose images may be recorded by our CCTV system.   

4. WHAT ARE THE CATEGORIES OF PERSONAL DATA PROCESSED?   

RCN collects and records the images of the data subjects, as listed in Article 3 above, captured by the CCTV system for the purposes listed below under Article 5. There is no voice recording.  

5. WHAT ARE THE PURPOSES AND THE LEGAL BASIS OF THE CCTV SYSTEM PROCESSING ACTIVITY?  

Our cameras are placed in areas open to the public and certain areas not opened to the public, which are signaled by CCTV signs, for the following purposes and legal basis:

In the areas opened to the public:   

Ensure the security of people, of movable and immovable properties in places particularly exposed to the risk of vandalism, disruption, or theft (this mainly concerns the interior of our parks accessible to the public, entrances and exits, shopping areas, counters and checkouts).

  

RCN’s legitimate interest to ensure the safety of persons and property and further investigating violations against property or persons, as well as accidents, damage, unlawful acts and complaints.  

In the areas not opened to the public:   

Ensure the security of people and movable and immovable properties in places particularly exposed to the risk of vandalism, disruption, assault or theft (reception areas, storage areas, storerooms, areas dedicated to the personnel). 

  

RCN’s legitimate interest to ensure the safety of persons and property and further investigating violations against property or persons, as well as accidents, damage, unlawful acts and complaints.  

Disclosure of CCTV footage to judicial and law enforcement authorities (such as the police and courts).

Necessary to comply with a legal obligation to which the controller is subject.

6. WITH WHOM CAN WE SHARE YOUR PERSONAL DATA?  

We may share your personal data with the following recipients listed below for the purposes described above:   

  • authorized employees of RCN in charge of the security who may access the CCTV footage on a need-to-know basis, in accordance with their job function;   
    • service providers involved in the management of CCTV, such as those who provide IT and system administration services and security agents when appointed by RCN;  
    • the judicial and law enforcement authorities (such as the police and courts): if we are under a duty to disclose or share your personal data in order to comply with any legal obligation or to defend our rights and interests;
    • our (legal) advisors: in order to be able to determine our legal position and defend our rights.  We require all the data recipients listed above to ensure the privacy and security of your personal data in accordance with the GDPR and applicable local data protection laws. They are not allowed, to use your personal data for their own purposes but only for the specified purposes mentioned above and, as applicable, in accordance with our instructions.  

7. HOW LONG DO WE RETAIN YOUR PERSONAL DATA?

The images captured by the CCTV System will not be stored for longer than required in order to achieve the purposes identified in Article 5 above.  More specifically, CCTV footage will be kept for 72 hours, unless RCN needs to keep it for a longer period to deal with an incident or to respond to the request of law enforcement and/or judicial authorities or a data subject.  

8. WHAT ARE YOUR RIGHTS? 

You are entitled to exercise the following rights where we are processing your personal data:    

  • Right of access: You have the right to request access to your personal data processed and stored in accordance with applicable data protection laws, such as the GDPR.
  • Right of erasure: You have right to request erasure of your personal data in accordance with applicable data protection laws, such as the GDPR.
  • Right of restriction: You have the right to request the restriction of processing of your personal data in accordance with applicable data protection laws, such as the GDPR.
  • Right to object: You have right to object to the processing of your personal data when this processing is based on a legitimate interest. We will consider your objection and check the processing against the requirements of applicable data protection laws, such as the GDPR.  
  • Right of rectification: You cannot rectify CCTV images unless they are inaccurate or incomplete.
